Warranty Policy
Version 1.0 · Effective as of the date of quote issuance
1. Purpose and scope
This Warranty Policy (the "Policy") sets out the terms, conditions, periods, exclusions, and procedures under which Manufactura Koncept (the "Manufacturer") provides warranty coverage on products manufactured and/or installed by it, for the benefit of businesses or professionals who purchase such products for use in their commercial, industrial, or service activities (the "Client").
The purchase of any product from the Manufacturer implies full and unconditional acceptance of this Policy. Any different term or condition must be expressly agreed upon in writing by both parties.
2. Definitions
For the purposes of this Policy, the following terms mean:
- Product: display, fixture, furniture, or any goods manufactured by the Manufacturer in accordance with technical specifications previously agreed upon with the Client.
- Manufacturing defect: failure attributable solely to the Manufacturer's production process, occurring under normal conditions of use, storage, and operation.
- Assembly defect: failure attributable to the installation process, exclusively where such installation was performed or contracted directly with the Manufacturer.
- Apparent defect: one detectable through ordinary visual inspection at the time of Product receipt.
- Hidden defect: one not detectable through ordinary visual inspection at receipt and that manifests during normal use of the Product.
- Original installation site: the specific physical location where the Product was installed and delivered to the Client, documented in the delivery record and/or corresponding photographic evidence.
- Trackline: the Manufacturer's digital traceability and warranty validation platform, through which photographic and technical records of the Product are documented at the time of installation.
3. Warranty periods
3.1 Standard warranty (installation by Client or third parties)
When installation is performed by the Client or a third party unrelated to the Manufacturer, a warranty of one (1) year is provided, from the delivery date documented on the delivery note, invoice, or delivery record.
This warranty covers manufacturing defects only. It does not cover assembly defects, damage during transport or installation, or any event after delivery that is beyond the Manufacturer's direct control.
3.2 Extended warranty (installation by the Manufacturer)
When installation is performed or contracted directly with the Manufacturer, the warranty extends to two (2) years, from the installation date documented in the corresponding delivery record.
The extended warranty covers manufacturing and assembly defects and remains valid provided the Product stays at the original installation site. Relocation of the Product, in whole or in part, by the Client or any third party will automatically void the extended warranty, reducing it to the one (1) year standard warranty period and coverage.
4. Special conditions by product type
Certain product categories, due to their nature, materials, or components, are subject to special warranty conditions that take precedence over the general periods set out in Section 3.
4.1 Wood and wood-based products
For Products manufactured wholly or partially from natural wood, MDF, particleboard, plywood, or any wood derivative, a single warranty of one (1) year is provided, regardless of who performs the installation. The warranty covers manufacturing defects only and does not apply to:
- Natural variations in tone, grain, or texture inherent to the material.
- Movement, expansion, or contraction due to humidity or temperature changes.
- Deformation from exposure to humidity above 65% relative humidity or direct water sources.
- Aesthetic finish wear from use, cleaning with non-recommended chemicals, or prolonged exposure to direct sunlight.
4.2 Products with lighting systems
For Products incorporating lighting systems (LED, drivers, power supplies, transformers, light strips, spotlights, lit profiles, or any electrical or electronic component):
- Display structure: covered under the applicable general period (Section 3.1 or 3.2, as applicable).
- Electrical and electronic components: direct warranty of one (1) year from the delivery or installation date, regardless of who performs the installation. This warranty does not extend to the two (2) year period provided in Section 3.2, even when installation is contracted with the Manufacturer.
Expressly excluded from warranty coverage are damages to electrical components resulting from: connection to voltages other than specified, inadequate site electrical installations, voltage fluctuations, lightning strikes, interventions by unauthorized personnel, or use of transformers, drivers, or power supplies not provided by the Manufacturer.
5. Warranty validation via Trackline
From the date Trackline is enabled (planned for October 2026), any Product for which warranty coverage is sought must be registered on the platform for coverage to take effect.
5.1 Registration requirement
Registration in Trackline is a prerequisite for the warranty to take effect. It must be completed at the time of installation, before operational delivery to the Client and, in any case, within a maximum of twenty-four (24) hours from completion of installation. Registration must include at minimum:
- Unique Product identification via QR code or NFC tag assigned by the Manufacturer.
- Photographic evidence of the Product correctly installed at the original site, showing its surroundings and location.
- Geolocation data, installation date and time, automatically generated by the platform.
- Identification and contact details of the person responsible for installation.
5.2 Consequences of failure to register
- Installation by the Manufacturer: the Manufacturer is responsible for registration and, if failure to register is attributable to the Manufacturer, the warranty remains valid per Section 3.2.
- Installation by the Client or a third party: failure to register within the established period results in total loss of warranty with no possibility of remedy.
5.3 Rules for products installed before Trackline is enabled
Products installed before Trackline is enabled will be governed exclusively by the periods and conditions set out in Sections 3 and 4, without requiring platform registration.
6. Delivery inspection and reporting of defects
6.1 Apparent defects
Upon receipt of the Product, the Client must inspect it and note in writing on the delivery note or record any visible defect, damage, shortage, or nonconformity. Signing the delivery note or record without observations constitutes acceptance of the Product's physical condition and extinguishes any subsequent claim for apparent defects.
6.2 Hidden defects
Hidden defects may be claimed during the applicable warranty period, following the procedure set out in Section 8.
6.3 Defect must appear within the warranty period
For a defect to be covered under this warranty, it must manifest within the applicable warranty period. Defects appearing after the period expires will not be covered, even if it is alleged that the root cause originated within the warranty period.
7. General exclusions
This warranty does not cover, under any circumstances, the following:
- Damage occurring during transport, handling, or storage when performed by the Client or third parties unrelated to the Manufacturer.
- Damage resulting from installation performed by the Client or third parties not contracted with the Manufacturer.
- Relocation, modification, alteration, intervention, or repair of the Product by personnel other than the Manufacturer without prior written authorization.
- Normal wear from use, including scratches, dents, discoloration, finish dulling, and aesthetic deterioration from normal operation.
- Use of the Product for purposes other than those specified in its technical specifications or beyond its load capacity.
- Damage caused by external agents: excessive humidity, flooding, outdoor exposure, prolonged direct solar radiation, fire, vandalism, theft, accidents, electrical discharges, voltage fluctuations, or any force majeure or fortuitous event.
- Use of abrasive cleaners, solvents, acids, or any chemical substance not recommended by the Manufacturer.
- Aesthetic or structural modifications to the Product after delivery, including painting, coatings, drilling, or addition of components.
- Products whose identification, NFC tag, QR code, or serial number has been removed, altered, or is illegible.
- Products for which the Client has outstanding overdue balances with the Manufacturer. The warranty will be suspended during the period of default without extending the original warranty period.
- Damage or failures reported after the applicable warranty period expires.
8. Warranty claim procedure
8.1 Notification
The Client must notify the Manufacturer in writing as soon as reasonably possible and always within the applicable warranty period, by email to ventas@steliumk.com. The notification must include:
- Product identification (model and order number, invoice, or delivery note; additionally, QR code or NFC tag when Trackline applies).
- Detailed description of the defect.
- Photographic and/or video evidence of the defect.
- Copy of the invoice or delivery note.
- Trackline registration confirmation, where applicable.
8.2 Diagnosis
The Manufacturer will have ten (10) business days from receipt of the complete notification to carry out a technical diagnosis, either remotely or on-site, depending on the nature of the defect.
8.3 Resolution
Once confirmed that the defect is covered by this Policy, the Manufacturer may, at its sole discretion, choose to: (i) repair the Product, (ii) replace the defective component, or (iii) substitute the Product with an equivalent one. The choice among these options rests exclusively with the Manufacturer.
8.4 Warranty on repaired or replaced parts
Parts, components, or Products that are repaired or replaced will be covered for the remaining period of the original warranty, without the repair or replacement creating a new period or resetting the original warranty clock.
9. Limitation of liability
The Manufacturer's liability under this warranty is limited solely to the value of the defective Product. Under no circumstances shall the Manufacturer be liable for indirect damages, lost profits, consequential damages, loss of sales, reputational damage, loss of business opportunities, or any consequential loss suffered by the Client, its employees, its customers, or third parties.
This limitation applies to the maximum extent permitted by applicable law.
10. Final provisions
10.1 Modifications
The Manufacturer reserves the right to modify this Policy at any time. Modifications apply only to Products whose quote is issued after the new version takes effect.
10.2 Severability
If any provision of this Policy is declared null or unenforceable by a competent authority, such invalidity shall not affect the validity of the remaining provisions, which shall remain fully in force and enforceable.
10.3 Applicable law and jurisdiction
This Policy is governed by the laws of the United Mexican States. For its interpretation, enforcement, and compliance, the parties expressly submit to the jurisdiction of the competent courts of Guadalajara, Jalisco, waiving any other jurisdiction that may apply by reason of their current or future domicile.
